This document (as well as other documents mentioned herein) regulates the terms and conditions governing the use of this Website (www.pilatusbrand.com) and the purchase or acquisition of products and/or services on it (hereinafter, the “Conditions”).

For the purposes of these Conditions, the activity PILATUS carries out through the Website includes:

  • Products focused on eco-friendly wallets.

In addition to reading these Conditions, before accessing, browsing, and/or using this Website, the User must have read the Legal Notice and General Terms of Use, including the cookie policy, privacy policy, and data protection policy. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User consents to being bound by these Conditions and all of the above. If the User does not agree with all of this, they must not use this Website.

These Conditions may be modified. The User is responsible for reviewing them each time they access, browse, and/or use the Website, as the applicable Conditions will be those in force at the time of requesting the acquisition of products and/or services.

2. USER

Access, browsing, and use of the Website confer the condition of user (hereinafter referred to individually as the “User” or collectively as the “Users”), which implies acceptance, from the start of browsing, of all the Conditions set forth herein, as well as subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations.

The User undertakes to use the Website responsibly. This responsibility extends to:

  • Using this Website only to make legally valid inquiries and purchases or acquisitions.

  • Not making any false or fraudulent purchases. If such a purchase could reasonably be considered fraudulent, it may be canceled and the relevant authorities informed.

  • Providing truthful and lawful contact information, such as email address, postal address, and/or other data (see Legal Notice and General Terms of Use).

The User declares to be at least 18 years of age and to have legal capacity to enter into contracts through this Website.

This Website is primarily aimed at Users residing in Spain and Portugal. PILATUS does not guarantee compliance with the legislation of other countries, either wholly or partially. PILATUS declines all liability arising from such access and does not guarantee shipments or service provision outside Spain and Portugal.

3. PURCHASE OR ACQUISITION PROCESS

Duly registered Users may purchase on the Website by the means and forms established. They must follow the online purchase process at www.pilatusbrand.com, during which various products and/or services may be selected and added to the shopping cart or basket, and finally click on “Add to cart and Complete Order.”

The User must fill in and/or verify the requested information at each step. During the purchase process, before making payment, purchase data can be modified.

Afterwards, the User will receive an email confirming that PILATUS has received their order or purchase request (order confirmation). If applicable, the User will also receive an email when their order has been shipped. This information may also be available in the User’s personal account on the Website.

Once the purchase process is completed, the User agrees that the Website will generate an electronic invoice, which can be requested by email. The User may also obtain a paper copy of the invoice by requesting it from PILATUS via the Website’s contact form or the contact details provided above.

The User acknowledges being aware, at the time of purchase, of specific conditions of sale regarding the product and/or service in question, displayed on the Website next to its presentation or image, including (but not limited to): name, price, components, weight, quantity, color, product details, characteristics, delivery methods, and/or associated costs. By placing the order, the User fully accepts these specific conditions of sale.

Communications, purchase orders, and payments made during Website transactions may be archived and stored in PILATUS’ computerized records as evidence of the transactions, subject to reasonable security conditions and applicable laws, particularly Regulation (EU) 2016/679 (GDPR) on the protection of natural persons regarding personal data processing and the free movement of such data.

4. AVAILABILITY

All purchase orders received by PILATUS through the Website are subject to product availability and/or to circumstances or causes of force majeure (see Clause 9) affecting supply and/or service provision. If there are difficulties regarding supply or if products are out of stock, PILATUS commits to contacting the User and refunding any amounts paid.

No damages or compensation will arise from lack of stock. The User may always check availability before placing an order via info@pilatusbrand.com, the contact form, or live chat (if available).

5. PRICES AND PAYMENT

Prices displayed on the Website are final, in Euros (€), and include taxes, unless otherwise indicated, particularly regarding VAT.

Shipping costs are included in the final product prices shown on the Website. Delivery services are provided through Envialia Pozuelo.

The Website will not add any additional costs automatically; only those voluntarily selected by the User.

Prices may change at any time, but such changes will not affect confirmed orders.

Accepted payment methods: credit/debit card and PayPal.

PILATUS uses all means to ensure confidentiality and security of payment data transmitted during transactions. The Website uses a secure SSL (Secure Socket Layer) payment system.

Credit cards are subject to checks and authorization by the issuing bank. If payment is not authorized, PILATUS will not be liable for delays or non-delivery and cannot formalize a contract.

By clicking “Add to cart and Complete Order,” the User confirms that the payment method used is their own.

6. DELIVERY

Where physical delivery is required, deliveries will be made within the following territory: Europe.

Unless there are unforeseen or extraordinary circumstances, or product customization, the order will be delivered within the timeframe indicated on the Website according to the selected shipping method, and in any case, within a maximum of 30 calendar days from order confirmation.

If PILATUS cannot meet the delivery date for reasons attributable to it, the User will be informed and may choose to continue with the purchase by setting a new delivery date or cancel the order with a full refund. Home deliveries are made on business days.

If delivery cannot be completed due to the User’s absence, the order may be returned to the warehouse. The carrier will leave a notice explaining where the order is and how to reschedule delivery.

If the User expects to be unavailable at the delivery time, they must contact PILATUS to arrange a new date.

If 30 days pass since the order became available for delivery and it has not been delivered for reasons not attributable to PILATUS, the contract will be deemed terminated. Payments received will be refunded, except for additional delivery costs resulting from the User’s choice of a more expensive delivery method than the standard one offered by the Website, within a maximum of 14 calendar days from termination.

Delivery is deemed completed when the User or a third party acquires material possession of the products, evidenced by signature upon receipt.

Risk of loss or damage passes to the User upon delivery. Ownership passes once PILATUS has received full payment, including shipping costs, or upon delivery if later.

In accordance with Law 88/1330 on VAT, orders delivered within Spanish territory (except Canary Islands, Ceuta, and Melilla) are subject to Spanish VAT at the legal rate in force.

7. TECHNICAL MEANS TO CORRECT ERRORS

If the User detects an error when entering required data during the purchase process, they may correct it by contacting PILATUS through the Website’s contact form, customer service, or the contact details in Clause 1 (General Information).

Before clicking “Add to cart and Complete Order,” the User has access to their shopping basket to review and modify their purchase details.

The User is also referred to the Legal Notice, General Terms of Use, and the Privacy Policy for further information on their right to rectification under GDPR (Regulation (EU) 2016/679).

8. RETURNS

Right of Withdrawal

The User, as a consumer, has the right to withdraw from a purchase within 14 calendar days without providing justification.

This period expires 14 calendar days from the day the User, or a third party designated by them (other than the carrier), acquires material possession of the goods. If multiple goods are delivered separately, the period runs from receipt of the last item. For service contracts, the period begins on the date of contract conclusion.

To exercise this right, the User must notify PILATUS through the Website’s contact form or other contact details provided.

Notification must clearly and unequivocally express the intention to withdraw.

In case of withdrawal, PILATUS will refund all payments received, except shipping costs, within 14 calendar days from being informed. Refunds will use the same payment method as the original purchase, with no additional cost to the User. PILATUS may withhold the refund until the goods are received or proof of return is provided.

Products purchased at a discount will incur an additional return fee of €4.95.

The User must return goods within 14 calendar days of notifying withdrawal. The User bears the direct cost of return shipping and is responsible for any diminished value caused by handling beyond what is necessary to establish the nature and functioning of the goods.

Exceptions to the right of withdrawal include (Article 103 of Royal Legislative Decree 1/2007):

  • Personalized products

  • Perishable goods

  • Unsealed CDs/DVDs

  • Products unsealed after delivery for hygiene/health reasons

No refunds will be made for used products beyond simple opening, products not returned in original condition, or products damaged after delivery. Returns must include all original packaging, instructions, documents, and a copy of the invoice.

Defective Products or Shipping Errors

If the User considers a product defective or not as agreed at delivery, they must contact PILATUS immediately.

PILATUS will inform the User of the return procedure. Once returned, the product will be examined, and the User notified within a reasonable period whether a refund or replacement will proceed.

Refunds or replacements will be made as soon as possible and within 14 days of confirming eligibility. Refunds include delivery costs and return costs.

Warranties

The User has a 2-year legal warranty from delivery for product non-conformity. Products are considered compliant if:

  • They match PILATUS’ description and qualities

  • They are fit for normal purposes of similar goods

  • They have the expected quality and performance

Some products may have non-homogeneous characteristics due to the nature of the material, which are not considered defects.

If the product is from a third-party brand or manufacturer, the User may also contact them directly to exercise warranty rights within 2 years.

9. LIABILITY DISCLAIMER

Unless otherwise required by law, PILATUS accepts no liability for:

  • Losses not attributable to its breach

  • Business losses (e.g., lost profits, revenue, contracts, data, goodwill, unnecessary expenses)

  • Other indirect losses not reasonably foreseeable when the contract was made

Further limitations:

  • Product images may show slight differences due to screen resolution or browser issues

  • PILATUS is not liable for transport delays or issues caused by strikes, roadblocks, or sector-specific problems

  • Technical failures preventing normal operation of the Website

  • Unavailability due to maintenance

  • Misuse or wear of products by the User

  • Incorrect returns made by the User

PILATUS is not liable for breaches caused by force majeure, including (but not limited to):

  • Strikes, lockouts, labor unrest

  • Civil commotion, invasion, terrorism, war

  • Fire, explosion, storm, flood, earthquake, epidemic

  • Inability to use transport or communication systems

  • Acts, decrees, regulations, or restrictions by government authorities

Obligations will be suspended during the force majeure period. PILATUS will make reasonable efforts to resolve the situation.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User accepts that communications with PILATUS will be electronic (email or notices on the Website).

For contractual purposes, the User consents to electronic communication and acknowledges that such communications meet legal requirements of being in writing.

The User may contact PILATUS through the details provided in these Conditions. Unless otherwise stated, PILATUS may also contact the User via email or postal address.

11. WAIVER

Failure by PILATUS to enforce a right or require strict performance of obligations by the User shall not constitute a waiver.

No waiver by PILATUS shall be effective unless expressly stated in writing and communicated to the User.

12. SEVERABILITY

If any provision of these Conditions is declared null or void by a competent authority, the remaining provisions shall remain valid and enforceable.

13. ENTIRE AGREEMENT

These Conditions and any expressly referenced documents constitute the entire agreement between the User and PILATUS, replacing any prior verbal or written agreements.

The User and PILATUS acknowledge that they have entered into the contract without relying on statements not expressly included herein.

14. DATA PROTECTION

Personal information provided by the User during transactions will be processed in accordance with the Website’s Privacy Policy. By accessing, browsing, and/or using the Website, the User consents to such processing and declares that the information provided is truthful.

15. APPLICABLE LAW AND JURISDICTION

Access, browsing, and/or use of this Website, as well as contracts for product purchases through it, shall be governed by Spanish law.

Any disputes shall be submitted to the non-exclusive jurisdiction of the Spanish courts.

16. COMPLAINTS AND CLAIMS

The User may send complaints, claims, or comments to PILATUS using the contact details provided at the beginning of these Conditions.

Official complaint forms are also available to consumers upon request.

In case of disputes arising from a contract between PILATUS and the User, the User may request out-of-court resolution under Regulation (EU) 524/2013 on online consumer dispute resolution.
